Most South Carolina property, homeowner associations and other common-interest developments are non-profit corporations and as such must adhere to the provisions in the South Carolina Non-profit Act. Many involved in community association governance are unaware that this Act is applicable to their operations and therefore may not be in compliance or may partake in activities that are unlawful. Ignorance is not bliss, nor an acceptable excuse for non-compliance in the eyes of the courts.
The Act is a very lengthy and complex set of regulations that are cumbersome to review and analyze. Among other issues, it addresses directors and officers, records and reports, amending bylaws and other mandates applicable to non-profit corporations of all types, including community associations.
This seminar, developed by Joe DaPore, Esq., Robert Hadden, Esq. and Sandra Salmon, SC Chapter CAI Board Member, will explain the applicable provisions in laymens terms so that professional managers and community volunteer leaders can appropriately advise their community associations and keep them out of trouble.
